These Terms form a binding agreement between you and the operator of HealthyBite (“we,” “us,” or “our”). They govern your access to and use of the Service, including the website, applications, and related features. We may update these Terms from time to time (Section 18); your continued use after an update means you accept the revised Terms.
You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the Service. If you are under the age of majority, you may use the Service only with the involvement of a parent or guardian. By using the Service you represent that you meet these requirements and that the information you provide is accurate.
HealthyBite helps you discover restaurants that may fit your dietary preferences by combining mapping/place data, restaurant information from the web, and AI‑generated estimates. The Service is provided for general informational and convenience purposes only. We do not operate, endorse, or guarantee any restaurant, and we are not a party to any transaction between you and a restaurant.
You may use the Service as a guest, in which case your dietary preferences are stored only on your device. Some features (such as saving favorites and submitting ratings or reviews) require an account. When you create an account, your username is your email address. You are responsible for the confidentiality of your credentials and for all activity under your account, and for notifying us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms.
HealthyBite offers an optional paid subscription (“HealthyBite Premium”) that unlocks additional features such as menu‑photo scanning. Premium is billed on a recurring annual basis through the platform you subscribe on — the Apple App Store, Google Play, or our web payment processor (handled via RevenueCat and its payment partners).
Your subscription automatically renews at the then‑current price at the end of each billing period unless you cancel at least 24 hours before the renewal date. Payment is charged to your chosen payment method upon confirmation of purchase and again at each renewal.
You can view your renewal date and manage or cancel your subscription at any time in your App Store or Google Play account settings, or via the billing portal on the web. Cancelling stops future renewals but does not retroactively refund the current period, and you keep Premium access until the end of the period you already paid for.
Refunds are handled by the platform that processed your payment (Apple, Google, or our web processor) and are subject to their policies; except where required by applicable law, payments are non‑refundable. We may add, change, or remove Premium features and may change pricing prospectively; where required we will give notice, and any price change applies only to future renewals (you may cancel before it takes effect).
Dietary lifestyles, allergens, diet patterns, religious requirements, match/option counts, and per‑item flags are estimates, not certifications. We do not verify, test, or inspect any food, kitchen, or preparation process. Menus, prices, hours, locations, and availability change without notice. You assume all risk arising from your reliance on any dietary information presented in the Service.
The Service is not a substitute for professional medical, nutritional, allergy, or health advice, diagnosis, or treatment. Always seek the advice of a qualified professional regarding any dietary or medical condition. Never disregard professional advice or delay seeking it because of something in the Service. In an emergency, call your local emergency number.
If you submit ratings, reviews, reports, menu photos, or other content (“User Content”), you represent that it is accurate, lawful, and your own, and you grant us a worldwide, non‑exclusive, royalty‑free license to host, display, reproduce, and use it to operate and improve the Service. Do not submit content that is false, defamatory, harassing, infringing, or otherwise objectionable. We may remove or moderate any User Content at our discretion but are not obligated to monitor it.
You agree not to: (a) use the Service for any unlawful purpose or in violation of any law; (b) scrape, harvest, reverse‑engineer, overload, or interfere with the Service or its infrastructure; (c) attempt to gain unauthorized access to any account or system; (d) misrepresent your identity or affiliation; (e) submit false reports or manipulate ratings; or (f) use the Service to infringe the rights of others.
The Service relies on and links to third‑party sources, including mapping and geocoding providers, restaurant websites, AI providers, and payment processors. We do not control and are not responsible for third‑party content, accuracy, availability, or practices. Your use of third‑party services is governed by their own terms and policies.
The Service, including its software, design, text, and branding, is owned by us or our licensors and is protected by intellectual‑property laws. We grant you a limited, personal, non‑transferable, revocable license to use the Service for its intended purpose. You may not copy, modify, distribute, sell, or create derivative works from the Service except as expressly permitted.
We collect and process only what is needed to provide the Service: your dietary profile, favorites, and reviews; your location (with your permission) to find nearby restaurants; and, if you create an account, your email address and authentication data. If you subscribe, we and our payment partners process the billing data needed to manage your subscription (such as your subscription status, plan, and a payment‑provider identifier); we do not receive or store your full card number. Guest data is stored locally on your device. Account data is stored with our cloud provider (Google Firebase) to sync across your devices. We do not sell your personal information. You can clear your local data at any time from Settings, and you can delete your account and its synced profile from Settings, subject to limited retention required for legal or security purposes. We use reasonable measures to protect your data but cannot guarantee absolute security.
The Service may display advertising provided by Google (Google AdSense). Google and its partners may use cookies or similar technologies and device identifiers to serve and measure ads, including based on your prior visits to this and other sites. We do not share your dietary profile, reviews, or account details with advertisers. You can review and control ad personalization at myadcenter.google.com, and learn more at policies.google.com/technologies/ads.
If you grant location permission, your device location is used to search for nearby restaurants and is sent to our mapping provider for that purpose. You can disable location access in your device or browser settings; some features may not work without it.
The Service and all content are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, we disclaim all warranties, including merchantability, fitness for a particular purpose, title, and non‑infringement, and any warranty that the Service or any dietary or restaurant information is accurate, complete, reliable, current, safe, or error‑free, or that the Service will be uninterrupted or secure. No advice or information obtained from the Service creates any warranty not expressly stated here.
To the fullest extent permitted by law, in no event will we or our owners, operators, or suppliers be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, or goodwill, or for any personal injury, illness, allergic or adverse reaction, or death, arising out of or relating to your use of (or inability to use) the Service or any reliance on dietary or restaurant information, whether based in contract, tort, negligence, strict liability, or any other theory, even if advised of the possibility of such damages. Our total aggregate liability for all claims relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or USD $50. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
You agree to indemnify, defend, and hold harmless HealthyBite and its owners, operators, and suppliers from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your User Content, or your violation of these Terms or any law or third‑party right.
You acknowledge that choosing where and what to eat — especially with a food allergy or medical dietary need — involves inherent risk the Service cannot eliminate. You voluntarily assume all such risk and agree that verifying food safety with the restaurant is solely your responsibility.
We may modify, suspend, or discontinue the Service or any feature at any time. We may revise these Terms by posting an updated version and, where appropriate, requiring renewed acceptance. You may stop using the Service at any time. We may suspend or terminate your access for any violation of these Terms.
These Terms are governed by the laws of the State of Arkansas and the applicable laws of the United States, without regard to conflict‑of‑laws rules. Before filing any claim, you agree to first contact us and attempt in good faith to resolve the dispute informally for at least 30 days. Any dispute not resolved informally will be brought exclusively in the state or federal courts located in Arkansas, and you consent to their jurisdiction and venue, except where prohibited by law. If any provision of these Terms is held unenforceable, the remaining provisions remain in full effect. Our failure to enforce any provision is not a waiver. You may not assign these Terms; we may assign them in connection with a transfer of the Service. These Terms are the entire agreement between you and us regarding the Service.
