Copyright Policy
We respect copyright and expect HealthyBite users to do the same. This page explains how to tell us about content you believe infringes your copyright, how a user can respond, and how restaurants can ask us to remove their material. It follows the U.S. Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512.
Restaurants: removing your menu, photos or images
HealthyBite shows restaurant menus read from restaurants’ own websites, and pictures from restaurant websites and other public sources. If you own or run a restaurant and want your menu, photos or images taken down, email Healthybiteapp@gmail.com with the subject “Copyright notice”. Tell us the restaurant’s name and address, what you want removed, and how you are connected to the restaurant. You don’t need to send a formal DMCA notice for this. We honor these requests.
Removing a menu means diners will see fewer dish marks for your restaurant. If the menu is simply out of date, tell us and we’ll refresh it instead. To stop our menu reader visiting your website in future, you can also block it in your robots.txt file; see HealthyBiteBot.
Sending a copyright notice
If you believe content on HealthyBite infringes your copyright, send a written notice to our copyright agent (below). Under 17 U.S.C. § 512(c)(3), the notice must include:
- A physical or electronic signature of the copyright owner or of a person authorized to act for them.
- Identification of the copyrighted work you say is infringed. If several works are covered by one notice, a representative list.
- Identification of the material you say is infringing, with enough information for us to find it, such as the restaurant’s name and address and a description or screenshot of the review, photo or menu.
- Your contact information: name, postal address, telephone number and email address.
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent or the law.
- A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act for the owner.
A notice that leaves out these elements may not be valid. If you knowingly misrepresent that material is infringing, you may be liable for damages under 17 U.S.C. § 512(f).
Our copyright agent
Send notices and counter-notices to the operator of HealthyBite, by email to Healthybiteapp@gmail.com with the subject “Copyright notice”. A postal address is available on request.
If your content was removed: counter-notice
If we removed something you posted because of a copyright notice, and you believe that was a mistake, you can send a counter-notice to our copyright agent. Under 17 U.S.C. § 512(g)(3), it must include:
- Your physical or electronic signature.
- Identification of the material that was removed and where it appeared before it was removed.
- A statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your name, address and telephone number, and a statement that you consent to the jurisdiction of the U.S. Federal District Court for the judicial district where your address is (or, if your address is outside the United States, any judicial district in which we may be found), and that you will accept service of process from the person who sent the original notice, or their agent.
We will send a copy of a valid counter-notice to the person who sent the original notice. If they don’t tell us within 10 business days that they have filed a court action to stop the infringement, we will restore the material within 10 to 14 business days after we received the counter-notice.
Repeat infringers
In appropriate circumstances, we disable or close the accounts of users who repeatedly infringe copyright. We keep track of valid notices against each account so we can do this.
